Employment Agreements
Employment agreements and policies set the foundations for the employment relationship.
They are the cornerstone for establishing the agreed terms and conditions of the employment relationship , the processes to follow and the obligations that each party are bound by.
Employment agreements clearly written, covering required provisions and minimum conditions reduce the risk of misunderstandings that can lead to personal grievance.
Every employee must be provided with a written employment agreement, all employers must hold a signed copy of the employment agreement that covers the current terms and conditions of the employment, either as a collective or an individual agreement.
The employment agreement must be the correct agreement, the requirements for fixed term and casual arrangements are different if these contracts are wrong it could lead to these employees by default becoming permanent employees.
Contractors must be provided with an agreement that is a “contract for services”, not an employment agreement, it will need to satisfy specific legal tests or it may lead to the contractor being granted permanent employment status.
